Common NDIS Decisions You Might Disagree With

There are many different decisions made by the NDIS that participants or their families might want to question or challenge. Some of the most common include:

  • Decisions about eligibility for the NDIS

Step 1: Request an Internal Review of the NDIS Decision

The first step is to ask the NDIA (National Disability Insurance Agency) for an internal review of the decision. This means someone who wasn’t involved in making the original decision will review the case and determine if it was correct.

You have 3 months from the day you receive the decision in writing to ask for an internal review. To make your request, you can:

  • Complete an NDIS Review of a Decision form
  • Email or call the NDIA
  • Ask your Support Coordinator (like the team at Angels on Wheels) to help you submit the request

It’s important to explain why you disagree with the decision and include any supporting documents, such as medical reports or therapy assessments.

Step 2: Apply to the Administrative Appeals Tribunal (AAT)

If you are not satisfied with the outcome of the internal review, you can apply to the Administrative Appeals Tribunal (AAT) for an external review. The AAT is an independent body that will review the decision and has the power to change it.

There’s no cost to apply to the AAT for an NDIS decision review. However, having the right documentation and support is crucial to presenting your case clearly and effectively.
